Terms of Service
These terms govern your use of blueplate, operated by [[ENTITY_NAME]]. By creating an account you agree to them. If you are agreeing on behalf of a business, you confirm you may bind that business.
What the service does
blueplate hosts digital menus. You build a menu, we publish it at a public address and generate a QR code pointing at it. Guests read the menu in a browser. blueplate does not take orders, process payments between you and your guests, or deliver food.
Your account
You are responsible for what happens under your account, including anything done by staff you invite. Keep your password to yourself. Tell us at [[CONTACT_EMAIL]] if you think someone else has access. One person or business per account; do not share logins.
Your content, and who is responsible for it
Your menu is yours. You keep every right in the text and images you upload, and you grant us only the permission needed to host and display them — storing, resizing, and serving them to your guests — for as long as you keep them on the service.
You are solely responsible for the accuracy of your menu, and that includes allergen and dietary information. The dietary labels available in the builder are descriptive tags you apply yourself. We do not verify them, we do not check them against any regulatory list, and applying one is not a substitute for whatever allergen disclosure your jurisdiction requires. Prices, availability, and ingredient claims are likewise yours to keep correct.
You confirm you have the right to use everything you upload, and that your content is lawful and not misleading.
Acceptable use
You agree not to:
- Publish unlawful, deceptive, or infringing content.
- Impersonate another business, or claim a slug in order to sell it or to mislead.
- Probe, overload, or interfere with the service or its infrastructure.
- Use automated means to inflate menu view counts, yours or anyone else's.
- Resell the service without our written agreement.
Plans and payment
A free plan is available. Paid plans are billed monthly in advance through our payment processor and renew automatically until cancelled. Plan limits — how many venues, categories, and items, and which features are included — are shown on the pricing page and enforced by the service.
You may cancel at any time from your account. Cancellation stops future renewals; your plan runs to the end of the period you have already paid for. [[REFUND_POLICY]]
If a payment fails, your plan stays active for a grace period of 14 days while we retry, so a declined card does not immediately change what your guests see. If payment is still outstanding after that, the account returns to the free plan and paid features stop. Your menus stay online either way — we do not take a published menu down because of a billing problem.
We may change prices with at least 30 days' notice by email. Continuing after the change takes effect means accepting the new price.
Availability
We work to keep the service up but do not promise uninterrupted availability. We may need to suspend it for maintenance or for reasons outside our control. The service is provided "as is", without warranties beyond those that cannot lawfully be excluded.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or lost business, and our total liability in any 12-month period is limited to what you paid us in that period. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Ending the agreement
You may stop using the service and delete your account at any time; deletion is immediate and permanent, and is described in the Privacy Policy. We may suspend or close an account that breaches these terms, and will normally give notice and a chance to put it right first, unless the breach makes that inappropriate.
Changes to these terms
We may update these terms. Material changes will be notified to account holders by email before they take effect, and the date at the foot of this page reflects the current version.
Governing law
These terms are governed by [[GOVERNING_LAW]], and disputes fall to the courts of that jurisdiction.
